We’re increasing our mediation fees

To make sure we can continue to provide our expert alternative dispute resolution services, we need to increase our mediation fees.

The Victorian Small Business Commission’s (VSBC) mediation fees have not increased in over 15 years and there is a need to increase the contribution that each party makes towards to the actual cost of our mediations.

For applications received from 1 September 2023, mediation fees for each party will increase from $195 to $300 (incl. GST) for a half-day session and $390 to $600 (incl. GST) for a full-day session. This includes mediation fees for those with disputes under the Owner Drivers and Forestry Contractors Act 2005 (which have historically been charged at $95).

To ensure our services stay low cost, the remainder of the actual cost of providing the mediation will continue to be subsidised by the Victorian Government.

Farm debt mediations are an exception, remaining at $195 per party.

Continuing with a fee structure that has remained the same for over 15 years has become increasingly challenging, prompting our review.

By taking a measured approach to these increases, we’re ensuring we can continue helping Victorians to resolve commercial disputes without the high cost, stress and lengthy delays that can come with litigation.

(Update – July 2024)

Previously gig workers in dispute with their digital platforms did not pay mediation fees thanks to funding from Industrial Relations Victoria, however that arrangement concluded 1 July 2024 and gig workers are now required to pay mediation fees.
