Who can make a complaint about a VSBC mediation session?
We require the actual party to the dispute to make the complaint. A complaint can be sent to us via their representative such as an agent or lawyer.
What happens if I make a complaint?
If you send us a complaint about our services, we will contact you within five working days. We will let you know we have received your complaint and are reviewing the concerns you have raised.
The Commissioner will appoint a VSBC staff member to carry out the review. During the review, you might be contacted with a request to discuss your complaint or to provide further information.
Once we have completed the review, the Commissioner will contact you with the outcome.
What if I made an agreement at mediation and have since changed my mind or am no longer satisfied with the agreement?
The VSBC cannot set aside, rewrite or enforce an agreement that has been reached at mediation.
There are, however, steps you can take. If you want to challenge or enforce an agreement, it might be appropriate for you to apply to the Victorian Civil and Administrative Tribunal (VCAT). Before doing so, you might want to consider getting legal advice.
